Weathering Debt
A Self-Help Guide to Complete Debt Resolution
You, as a consumer, are protected by Federal and State laws. It is general practice for many creditors and collectors to take advantage of the fact that most consumers aren't aware of the laws that govern the creditors and collectors. The FTC provides a Consumer Alert on their web site that states what to be watchful for in credit repair as well as what you can do for yourself.
We made a point of using this information as a basic template to create this guide.
The FTC lists things to be wary of when searching for a company.
We decided, after long research, that there wasn't a system that addressed all the necessary things that needed to be resolved in order to have a "healthy" financial life.
The FTC says that if a "company wants you to pay for credit repair services before they provide any services" that they are breaking the law. "Under the Credit Repair Organizations Act, credit repair companies cannot require you to pay until they have completed the services they have promised."
We don't offer credit repair services. We provide an education about things that the credit industry doesn't want you to know and explain the laws so that everyone can understand them, not just an attorney. You do it yourself and have the ability to give your finances the attention they deserve.
We will say here one cruel harsh truth that no one in the industry wants you to hear, the one thing that changes everything. If you are in financial trouble already, your credit rating is already in the crapper and that can't be fixed, even if you pay off all of your debts. To maintain a strong credit score, you must pay all of your debts on time, as agreed, which means minimum monthly payments every month on time. Your score actually suffers if you pay your debt off early. This is why the actual formula for how to figure your score is unavailable. If everyone could see how the credit industry works, they would understand that it is designed to destroy consumer's credit ratings, not make them better. What started out as simply a means to help a consumer and the lending institution balance out whether or not the amount of money coming in could support the amount of debt being created has become something far more sinister. The credit industry wants to keep you the consumer in the dark because if you knew what they were doing, you wouldn't be willing to play the game any more. Who wants to play a game that can only be won with perfection? Do you know anyone that is perfect? We don't and what we offer is a way to win and beat their game… the only way: Stop playing their game.
The FTC also says that most companies won't "tell you your rights and what you can do for yourself for free".
We do. We explain in detail all of your rights and how you can protect yourself from an abusive system and predatory lenders that are intent on making money at any cost.
The FTC says to be wary of companies that recommend that you do not contact any of the three major national credit reporting companies directly.
We encourage you to contact the credit reporting agencies directly. Knowledge is power and understanding what is happening with your credit file is crucial to taking back control of your financial life.
The FTC warns about companies that tell you they can get rid of most or all the negative credit information in your credit report, even if that information is accurate and current.
The fact is that if there is a complete and accurate listing in your credit report, you are stuck with it. What isn't mentioned is that you still have options. With our system of debt resolution, you will see how to make the companies that are reporting to your file prove that the information is yours or remove the listing as well as show you how the laws are set up to protect you from collectors that are willing to bend or even break the rules to collect on a debt, regardless whether or not it is yours. Even if the debt is yours you still have options and we show you how you can negotiate with companies and what you can do to resolve that debt for a win-win outcome.
The FTC strongly warns about companies that suggest unethical or illegal tactics, such as suggesting that you try to invent a "new" credit identity — and then, a new credit report — by applying for an Employer Identification Number to use instead of your Social Security number.
We will never suggest that someone do something unethical or illegal and we show you how you can get out of the storm and still keep your integrity and honor. We go to great lengths to point out that a lot of the problems in this industry stem from illegal and unethical practices and for the consumer to truly be free of problem, they MUST not be a part of the problem.
The FTC warns about companies that advise you to dispute all the information in your credit report, regardless of its accuracy or timeliness.
This is a common tactic of credit repair companies. The idea here is that you dispute everything at once and while all the disputes are being investigated, they aren't allowed to be reported. This allows for a consumer to have a brief window in time where their score jumps up considerably and allows for them to either get a loan that they couldn't have gotten before, or a better interest rate. This is a very bad idea for several reasons.
First and foremost is "universal default". Universal default is a clause that is now in almost every credit contract that states that if you default on one of your loans, then all your lenders have the right to hike your rates, even if you did nothing wrong with them. Once all that information comes back, the universal default clause kicks in and that great rate you had cruises on up to the stratosphere.
Another major problem with this tactic, aside from the fact that it is fraudulent, is that it destroys the one and only thing that your credit score is good for, keeping track of your debt to income ratio. This is the ratio that determines whether or not you can actually carry more debt without collapsing under the burden of it. Can you say bankruptcy-looking-for-a-place-to-happen?
Aside from a lot of other issues that come up there is one other major problem with a credit repair company. The law provides a loophole by which the credit reporting agencies may now disregard a dispute if they believe that it is coming from a credit repair company.
What we show you is how to utilize the system properly so you may avoid these pitfalls, have a win-win outcome and still feel good about yourself when it is all said and done.
